Terms and Conditions of Participation of the STACKIT PowerMonths selection process

The entity conducting the STACKIT PowerMonths selection process is Schwarz IT KG, Stiftsbergstraße 1, 74172 Neckarsulm (“SIT“). Participation in the STACKIT PowerMonths selection process is possible only under the terms and conditions set out here.

  1. Eligibility and participation process

Groups consisting of minimum two and maximum six people, each of whom is at least 18 years of age and enrolled as a computer engineering student at a university in Germany are eligible to participate (“Team“).

Participation in the STACKIT PowerMonths selection process is free of charge. To participate, Teams must complete and submit the online application form to SIT at https://www.stackit.de/en/powermonths/.

Participating as a Team requires that the person submitting the application form for the entire Team (“Team Captain“), has obtained authorization to submit the application for themselves and for the other Team members and confirms this accordingly by submitting the application form.

The Team Captain shall also inform all members of their Team of the opportunity to acknowledge the separately issued privacy policy, available at PowerMonths privacy policy – STACKIT.

2. Exclusion of participants and/or Teams

If an individual Team member participates in different Teams, or the minimum number of Team members is not met or the information submitted is incorrect, the individual Team member or an entire Team may be excluded from the STACKIT PowerMonths selection process.

  1. Closing date for applications

All application forms submitted up to and including August 31, 2023 will be considered in the selection process. The decisive date is the date on which the application forms are received by SIT.

  1. Notification of the winning teams

SIT will select three winning teams from all of the properly submitted application forms. The winning teams will be selected by August 31, 2023. The Team Captains who have submitted the application forms will be notified if their Team’s application has been successful or not by e-mail at the latest by August 31, 2023. The winning teams will not be announced publicly.

SIT will select the winning teams at its own discretion on the basis of the following criteria:

  1. Prize

SIT will offer all of the members of the winning teams (“Winners“) the opportunity to enter into a fixed-term contractual relationship with SIT (“Collaboration Agreement“). Under this Collaboration Agreement, the Winners can work with SIT to plan and implement a cloud project (“Cloud Project“) within a private (non-commercial) or university context, based on the respective Team’s development idea. SIT will support the planning and implementation of the Cloud Project within the scope of the Collaboration Agreement by providing the following services (“Support Services“):

Concluding the fixed-term Collaboration Agreement between SIT and the respective Winners is mandatory in order to be able to implement the Cloud Project together with SIT; however, by entering into the Collaboration Agreement, the respective Winners are not obliged to implement the Cloud Project and may terminate a given Collaboration Agreement at any time, even prior to the end of its term. The conclusion and processing of the Collaboration Agreement, planning and implementation of the Cloud Project and the Support Services provided by SIT shall take place completely in digital form; appointments or any other on-site events at SIT are not planned. If a Winner is not prepared to enter into the Collaboration Agreement, the Winner in question will not be able to take part in the planning and implementation of the Cloud Project and will not receive any Support Services from SIT. Entering into a Collaboration Agreement will not entail any costs for the Winner with regard to the SIT services; the costs of the SIT Support Services will be borne by SIT itself. The term of the Collaboration Agreement is from Ocotber 01, 2023 to February 29, 2024. SIT will not provide any further Support Services after the Collaboration Agreement expires. If desired, SIT will issue the Winners with a confirmation of their participation in the Cloud Project after the Collaboration Agreement has ended; the Winners themselves are responsible for any credits acquired by participating in the Cloud Project vis-à-vis their university. Winners who refuse to enter into the Collaboration Agreement do not have any claims for compensation. In the event that fewer than two members of a winning team are willing to conclude the Collaboration Agreement with SIT, any remaining individual member who would be willing to conclude the Collaboration Agreement with SIT will not be able to participate in the implementation of the Cloud Project due to the lack of a Team and will not receive any Support Services from SIT; a corresponding Collaboration Agreement will not be concluded in this case (“winning team drops out“). If a winning team drops out, SIT will nominate a replacement winning team and contact them by e-mail via their Team Captain. The conclusion of a Collaboration Agreement does not establish an employment relationship. A cash payment in lieu of the prize is excluded.

  1. Miscellaneous

Should any provision of these Terms and Conditions of Participation be or become invalid, either in whole or in part, this shall not affect the validity of the remaining provisions of the Terms and Conditions of Participation. SIT reserves the right to end the STACKIT PowerMonths selection process in full or in part without notice and without providing any reasons, especially if circumstances arise that may jeopardize the integrity of the STACKIT PowerMonths selection process.

  1. Exclusion of recourse to a court of law

No recourse may be had to a court of law.
